Imagine falling in love with a home — only to find out your dog isn’t allowed because of HOA rules. Pet rules aren’t just legal fine print — they are a huge part of our day-to-day lives. Pet rules aren’t always obvious on MLS listings. That’s why I help you review HOA docs, declarations, and community rules before you make a move on your next home.

In Alabama, homeowners associations (HOAs) have considerable discretion in setting pet policies. There are no specific state laws governing HOA pet restrictions, leaving associations to implement rules as long as they are clearly stated in their governing documents and do not violate federal laws.

🏘️ Some HOAs, condos, or townhome associations limit the number of pets, types of pets, or even specific breeds — especially in communities with shared spaces or managed green areas.

**Common HOA & Community Rules to Watch For:** 
• Breed restrictions (especially for perceived “aggressive” breeds) 
• Weight limitations per pet
• Total number of pets allowed 
• Fencing limitations or restrictions on leash-free time 
• Noise or nuisance clauses, which can affect vocal dogs

Enforcement and Exceptions:

  • Service Animals: Under the Fair Housing Act, HOAs must make reasonable accommodations for service animals, regardless of breed or size restrictions. It's important to note that there is a distinction betwen service animals and emotional support animals.

  • Grandfather Clauses: Existing pets may be exempt from new restrictions if they were in compliance before the rules changed.

  • Registration Requirements: HOAs may require pet owners to register their animals and provide proof of vaccinations.
